2. Pricing and Payment

Our standard pricing is as follows:

• Website Setup: $997one-time fee
• Monthly Management: $100 per month

Payment terms:

• The setup fee is due before work begins or as agreed upon in your proposal
• Monthly retainer fees are billed at the beginning of each month
• All fees are non-refundable unless otherwise stated
• Late payments may result in suspension of services

3. Client Responsibilities

To ensure successful project delivery, you agree to:

• Provide accurate and complete information necessary for the project
• Respond to requests for feedback or approval in a timely manner
• Ensure you have the rights to any content, images, or materials you provide
• Make payments according to the agreed schedule
• Notify us of any concerns or issues promptly

4. Intellectual Property

Upon full payment of all fees:

• You will own the final website design and content created specifically for your project
• We retain the right to display your project in our portfolio and marketing materials
• Any pre-existing materials, templates, or tools we use remain our property
• Third-party assets (stock images, fonts, plugins) are subject to their respective licenses

5. Revisions and Changes

We include reasonable revisions as part of our website setup service to ensure you are completely satisfied with the final result. Major changes to the project scope or significant additions beyond the original agreement may incur additional fees, which will be communicated and agreed upon before proceeding.

6. Monthly Retainer Services

Our monthly retainer includes:

• Regular content updates and minor edits
• Performance monitoring and optimization
• Security updates and backup management
• Technical support via email

The retainer does not include major redesigns, new page development, or features significantly beyond the scope of maintenance. Such requests will be quoted separately.

7. Cancellation and Termination

Monthly Retainer: You may cancel your monthly management service at any time by providing written notice. Cancellation will be effective at the end of the current billing period. No refunds will be provided for partial months.

Project Work: If you wish to cancel a project in progress, you will be responsible for payment for all work completed up to the date of cancellation.

8. Limitation of Liability

To the fullest extent permitted by law, Atlas Marketing Agency shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services or website. Our total liability shall not exceed the amount you paid for the services in question.

9. Disclaimer of Warranties

Our services are provided "as is" without warranties of any kind, either express or implied. While we strive to deliver high-quality work, we do not guarantee specific results such as search engine rankings, traffic increases, or conversion rates, as these depend on many factors beyond our control.

10. Indemnification

You agree to indemnify and hold harmless Atlas Marketing Agency from any claims, damages, losses, or expenses arising from your use of our services, your violation of these Terms, or your infringement of any third-party rights.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, United States, without regard to its conflict of law provisions.
